Oil Line Law takes effect October 1

Massachusetts has a new law to address oil leaks from home heating systems (Chapter 453 of the Acts of 2008, as most recently amended in 2010). This law has two major provisions that require:
• the installation of either an oil safety valve or an oil supply line with protective sleeve on systems that do not currently have these devices; and
• insurance companies that write homeowner policies to offer coverage for leaks from heating systems that use oil.
Most homeowner policies do not currently include such coverage, leaving many to pay for costly cleanups out of their own pocket. Although it is mandatory that insurance companies make this coverage available by July 1, 2010 to homeowners whose systems are upgraded, the insurance is an optional purchase.

Who must take action?
Owners of 1- to 4-unit residences that are heated with oil must already have or install an oil safety valve or an oil supply line with a protective sleeve. Installation of these devices must be performed by a licensed oil burner technician. Technicians are employed by companies that deliver home heating oil or are self-employed. It is important to note that heating oil systems installed on or after January 1, 1990 most likely are already in compliance because state fire codes implemented these requirements on new installations at that time.
Who is exempt?
Homeowners are exempt from taking these leak prevention steps if:
• the oil burner is located above the oil storage tank and the entire oil supply line is connected to and above the top of the tank OR
• an oil safety valve or oil supply line with protective sleeve was installed on or after January 1, 1990, AND
• those changes are in compliance with the oil burning equipment regulations; a copy of the oil burner permit from the local fire department may be used to demonstrate compliance.

Why comply?
Not only is complying with the new law required, it makes good financial and environmental sense. Homeowners who take these preventive measures can avoid the disruption and expense that can be caused by heating oil leaks. A leak may result in exposure to petroleum vapors in your home. If the leak reaches the soil or groundwater beneath your house, then a cleanup must be performed to restore your property to state environmental standards. Leaks that affect another property or impact drinking water supply wells can complicate the cleanup and increase the expense. Each year, several hundred Massachusetts families experience some kind of leak.
What will an upgrade cost?
The typical cost of installing either an oil safety valve or oil supply line with a protective sleeve ranges from $150 - $350 (including labor, parts, and local permit fees).
What could it cost to cleanup a leak?
The cleanup cost for a "simple" leak can be as much as $15,000. In cases where the leak impacts the groundwater or is more extensive, the cleanup costs can reach $250,000 or more.
What kind of insurance is available?
To be eligible for the new insurance coverage, homeowners must ensure that their oil heating systems are in compliance with the new law. Homeowners who have been certified to be in compliance with (or exempt from) the leak prevention measures qualify to purchase insurance that:
• provides "first party coverage" of at least $50,000 for the cost of cleaning up a leak to soil, indoor air, or other environmental media from a home heating system at the residence itself and reimbursement for personal property damage, AND
• provides "third party coverage" of at least $200,000 for the cost of dealing with conditions on and off the insured's property because the leak from this system has or is likely to impact groundwater or someone else's property. The coverage also includes costs incurred for legal defense, subject to a deductible not to exceed $1,000 per claim.
What should I do next?
• Determine whether you have had an oil safety valve or new oil supply line with protective sleeve installed since January 1, 1990. If you have, your permit from the fire department for the installation can be used to document your compliance. You can request a copy from the fire department if the permit is on file, or a licensed oil burner technician can certify that status on a form.
• If you do not have an oil safety valve or oil supply line with protective sleeve in place, have one or the other installed and certified. Either contact your oil delivery company to ask if they employ a licensed oil burner technician or find a service person in your area. Holden Oil employs licesed technicians.
• Consider buying insurance coverage for the cleanup of a leak.
o Determine whether your existing policy provides oil leak coverage.
o If it does not, consider calling your homeowner insurance agent to amend the policy to include this coverage.

Here comes Irene!

Hurricane Irene is fast approaching and we are here to help in any way. Both Propane Gas and Diesel Fuel are available for generator fueling and we have been running around the North Shore the last few days topping off tanks at places ranging from Hospitals to Fire departments to regular homes to help our customers prepare. Please remember that if your if your heating oil or propane gas fired appliances get wet, have a service person check them out before attempting to use them. Water will damage the controls and can create a safety issue. If your oil or propane gas tank is damaged or in danger due to the storm, please contact us as soon as possible. We have propane tanks in many locations that have already been secured but the fury of nature is very unpredictable. If you have concerns, please call us.

At this time of year, we frequently are asked what we think the price of heating oil is going to be this winter. My honest answer is no one knows. Heating oil, gasoline, and diesel fuel are now a financial instrument traded by speculators causing huge swings in wholesale prices every day. The prices of these products are determined more by hedge funds and investment houses than they are by supply and demand.

The Easy Pay budget program for the 2011-2012 season will be rolled out on August 1. We estimate your annual consumption and use the US Department of Energy projections to estimate your heating expense and break it into monthly payments beginning in August and continuing until June. The last few years we have had to adjust the monthly payments both up and down to reflect the actual cost of fuel during the year. What happened to the warm weather?

It is the middle of June and here we are with long sleeves and sweatshirts! The heating season is supposed to be over but many people are turning on the propane fireplaces to take the chill off. The Easy Pay Budget plan for Heating oil and propane ends this month with settlement statements having been mailed out on the First of June. The new Easy Pay Budget will start in August as it does each year. If you have been on the plan in the past year, we will automatically calculate your new plan. If you have not been on it and wish to be, just give us a call in the office.

The Easy Pay Budget is a way of spreading out your heating oil or propane gas payments out over eleven months. We estimate your usage based on the past several years and we estimate what your cost for the year will be based on government predicitions of the average cost of oil or propane. It is an inexact science and that is why some years we have either asked you to lower or raise your budget payments during the year with the hope that the final June payment will be as close to your actual balance as possible. Earth Day

Holden Oil was represented in the Riverfest-Earth Day celebration on the Rose Kennedy Greenway in Boston last Friday. We helped man the Bioheat booth and explain the benefits of bioheat and biofuels from an oil dealers prespective. There were thousands of people and great music!

On Saturday April 30th, Holden Oil will be displaying a Dixie Chopper propane powered commercial lawn mower at the Peabody Green Fest being held at the Peabody Community Life Center on Central Street. Propane powered mowers and lawn equipment are environmentally friendly and are very economical. Equipment Rentals

Rental bills for Propane tanks and equipment have been sent out, as they have for over twenty years. The rental allows Holden Oil to maintain, and replace when needed, your propane tanks and regulating equipment. Just as the electric utility and the natural gas utility charge a minimum fee each billing cycle to keep you connected to the grid, Holden Oil must insure a minimum return from the very expensive equipment that is provided. We have worked to keep the rental charges among the lowest in the industry, despite the huge increases in the cost of the equipment.

End of another winter

Yes, even us heating guys are ready to head into spring! With the snow this weekend, you get really antsy for the grass to start growing and the trees to bud out. In the oil and propane business, a system called degree days is used to help figure out how much fuel oil or propane you consume. If this year seems as though you may have used more than last year, you probably did because that is what the degree days are telling us. From September 1 until March 31, there has been roughly 4.25% more degree days than last year. For the average home in the northshore area, that amounts to about 35 gallons more heating oil consumed. Unfortunately, the price of heating oil is just about one dollar per gallon higher than last year and propane is about thirtyfive cents higher so that increase in consumption feels even worse.

Please remember the oil or propane man! That is the wish of the drivers responsible to get heating oil or propane gas to your home. As we continue on with this record setting snow pace, more and more oil fill pipes and propane tanks are becoming virtually unreachable. The drivers do their very best to make every delivery possible and we understand when someone is unable to clear a path for the driver but if at all possible please help the driver by shoveling.
